By accessing or using Whisper Flow ("Whisper Flow", "Service", "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

These Terms constitute a legally binding agreement between you ("User", "you") and Whisper Flow ("we", "us", "our").

2. Description of Service

Whisper Flow is a mobile application that provides:

• Voice-to-text transcription services
• Multilingual speech recognition
• Transcription history management
• Note-taking capabilities
• Cloud synchronization (optional)

3. Eligibility

You must be at least 13 years old to use Whisper Flow. By using the Service, you represent and warrant that:

• You are at least 13 years of age
• You have the legal capacity to enter into these Terms
• You will comply with these Terms and all applicable laws

4. User Accounts

4.1 Account Creation

To access certain features, you may need to create an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Be responsible for all activities under your account

4.2 Account Termination

We reserve the right to suspend or terminate your account if:

• You violate these Terms
• We detect fraudulent or illegal activity
• You misuse the Service
• We discontinue the Service

5. Acceptable Use

5.1 Permitted Use

You may use Whisper Flow for:

• Personal voice transcription
• Note-taking and documentation
• Multilingual communication
• Any lawful purpose consistent with the Service's functionality

6. Content and Intellectual Property

6.1 Your Content

You retain all rights to the content you create using Whisper Flow (transcriptions, notes, etc.). By using the Service, you grant us a limited license to:

• Process your voice input for transcription
• Store your transcribed text and notes
• Display your content within the App
• Use aggregated, anonymized data for service improvement

Important: Voice audio files are immediately deleted after transcription and are not stored permanently.

6.2 Our Intellectual Property

Whisper Flow, including its design, features, code, and content, is owned by us and protected by copyright, trademark, and other intellectual property laws. You may not:

• Copy, modify, or distribute the App
• Remove copyright or trademark notices
• Create derivative works
• Use our branding without permission

7. Privacy and Data Protection

Your privacy is important to us. Our collection and use of your information is governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review the Privacy Policy to understand our practices.

8. Subscription and Payments

8.1 Free Tier

Whisper Flow offers a free tier with limited features (e.g., 1,000 words per week).

8.2 Pro Tier (When Available)

Paid subscriptions may be offered for additional features:

• Unlimited transcriptions
• Offline mode
• Cloud sync
• Priority support

8.3 Payment Terms

• Subscriptions are billed on a recurring basis (monthly or annually)
• Payments are processed through Google Play Store or Apple App Store
• Prices are subject to change with 30 days notice
• You can cancel anytime through your app store account

8.4 Refunds

Refund policies are governed by Google Play Store and Apple App Store terms. Generally:

• Refunds may be available within 48 hours of purchase
• Contact the app store for refund requests
• We reserve the right to issue refunds at our discretion

9. Service Availability and Modifications

9.1 Service Availability

We strive to provide reliable service, but we do not guarantee:

• Uninterrupted or error-free operation
• 100% accuracy in transcriptions
• Availability at all times
• Compatibility with all devices or languages

9.2 Service Modifications

We may:

• Update or modify features
• Add or remove functionality
• Perform maintenance (with or without notice)
• Discontinue the Service with reasonable notice

11. Limitation of Liability

To the maximum extent permitted by law:

• We are not liable for any indirect, incidental, special, or consequential damages
• Our total liability is limited to the amount you paid us in the 12 months preceding the claim (or $100 if you used the free tier)
• We are not responsible for loss of data, profits, or business opportunities
• We are not liable for third-party actions or content

12. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Your content or conduct

13. Third-Party Services

Whisper Flow may integrate with or link to third-party services:

• Speech recognition APIs
• Cloud storage providers
• Analytics services

Your use of third-party services is subject to their terms and policies. We are not responsible for third-party services.

14. Dispute Resolution

14.1 Informal Resolution

If you have a dispute, please contact us first at support@sopay.us to seek an informal resolution.

14.2 Arbitration

If informal resolution fails, disputes will be resolved through binding arbitration rather than in court, except:

• Small claims court matters
• Intellectual property disputes
• Where arbitration is prohibited by law

14.3 Class Action Waiver

You agree that disputes will be resolved on an individual basis. You waive the right to participate in class actions or class arbitrations.

15. Governing Law

17. Termination

You may stop using the Service and delete your account at any time through Settings → Account → Delete Account.

• You violate these Terms
• We detect fraud or abuse

• We discontinue the Service

17.3 Effect of Termination

Upon termination:

• Your right to use the Service ends immediately
• We will delete your data as described in our Privacy Policy
• Provisions that should survive (e.g., liability limitations) will continue

18. Miscellaneous

18.1 Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and us regarding the Service.

18.2 Severability

If any provision is found to be unenforceable, the remaining provisions will remain in effect.

18.3 No Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right or provision.

18.4 Assignment

You may not assign these Terms without our consent. We may assign these Terms without restriction.

We are not liable for delays or failures due to circumstances beyond our control (e.g., natural disasters, pandemics, government actions).
